By using this site (www.talkinggrass.co.uk) you are agreeing to follow and abide by our Terms and Conditions and Privacy Policy. We may revise the Terms and Conditions and Privacy Policy at any time without notice to you.

If you refuse to accept these Terms and Conditions, you will not be able to order any products from our site.

Throughout these Terms and Conditions, we will refer to ourselves as “talking grass”, ‘us’ or ‘we’. When we say “talking grass”, ‘us’ or ‘we’, what we mean is Sara Gregson Marketing Communications Ltd, whose registered business address is 87 High Street, Hinxton, Saffron Walden, Essex, CB10 1QY. VAT number: 884 0607 12.

Trading terms

These Terms and Conditions will apply to all orders for the purchase of goods from the “talking grass” website. By placing an order, you are indicating your acceptance of these Terms and Conditions. By placing an order, you are indicating that you are an authorised user of the credit or debit card used to make the purchase and that there are sufficient funds to cover the cost of the goods. It is your responsibility to inform us of any changes to these details as soon as possible. This does not affect your statutory rights as a consumer.

Basis of the sale

We aim to give you a clear idea of the nature of the products that we sell. However, you appreciate that there may inevitably be some variations in size, shape and colour between different products. Illustrations, descriptions, photographs and other information pertaining to a specific product is approximate and for guidance only.

Seller: Buyer contract

After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us and we will confirm acceptance to you by sending you an email that confirms that the product has been dispatched (the ‘Order Completed email’). The contact between you and us will only be formed when we send you the Order Completed email (the Contract).

The contract will relate only to those products whose dispatch has been confirmed in the Order Completed email. We will not be obliged to supply any other products, which may have been part of the order until the dispatch of such products has been confirmed in a separate Order Completed email.

If you are contracting as a consumer, you may cancel a contract at any time within seven working days, beginning on the day after you received the products. In this case you will received a full refund of the price paid for the products in accordance with our refunds policy – see below.

To cancel a contract, you must inform us in writing. You must also return the products to us as soon as reasonably practical, and at your own cost. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. This does not affect your statutory rights as a consumer.

Warranty

We aim to provide high quality products to our customers. We are unable to provide any warranties in relation to goods provided over and above our statutory obligation to provide goods of satisfactory quality in accordance with the Consumer Rights Act 2015. This does not affect your statutory rights as a consumer.

Goods pricing

If the price of goods changes between the date we accept your order and the delivery date, you will pay the price you paid during your original transaction.

If, by mistake, we have under-priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we dispatch the product to you. In those circumstances, we reserve the right to cancel your order. In the event we cancel your order, we will give you a full refund on any amount already paid for that product in accordance with our return and refund policy.

You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

All prices are stated on the “talking grass” website, although “talking grass” reserves the right at any time to revise the price of goods at any time. All final prices are inclusive of VAT at the current rates and are correct at the current time of entering the information.

Availability of stock

We will use all reasonable endeavours to ensure that this website does not have any problems and that the goods displayed are available. However, we cannot guarantee the availability of the website or that any goods on the website are in stock or available.

We reserve the right to alter these Terms and Conditions without notice from time to time. These Terms and Conditions will be governed by the laws of England and Wales and by using the website you agree to submit to the exclusive courts of England and Wales.

Items listed as currently unavailable

If a product is listed as currently unavailable, this means you are unable to purchase that item at the present time. It may mean we are out of stock and are not sure if we can get more, or it may mean we have completely sold out for the current season.

Please note, we cannot guarantee any product will definitely become available to purchase again. For the most up-to-date stock information on a product, please see the individual product pages on our website.

Payment

All prices include VAT at the current rate where applicable. Your payment will be processed at the point of order.

If you wish to redeem a discount or offer code (eg 15% off, Free P&P, etc), please enter your code, bearing in mind any restrictions, in the box provided.

Payment must be by credit or debit card at the time of placing your order. Unfortunately we cannot accept cheques for payment.

Credit or debit card We accept VISA and MasterCard. We regret that we cannot accept payment by American Express.
PayPal

There is no additional charge for using a credit card. We work with reputable third party payment gateways, PayPal and Realex. They use digital signatures and strong encryption to ensure that all sensitive information is protected throughout every transaction.

We hold no information regarding your account details ourselves and shall have no responsibility for the online payment system.

Cancelling or amending an order

It is not possible to amend an online order via your online account. If you would like to make any amendments please email info@talkinggrass.co.uk and we will do our best to fulfil your request.

If you would like to cancel an order then please email info@talkinggrass.co.uk letting us know which items you would like to cancel and whether you would like a refund or credit for a future order.

Please note that if your order is already being processed, then we will be unable to amend or cancel your order. Therefore we advise you get in contact as soon as possible.

Refund and cancellation period

The cancellation period for sales through the “talking grass” website is 14 days from the day after the customer receives their order. To receive a full refund, it is the customer’s responsibility to pay and return the item to “talking grass” in its original and unused state. Failure to do so may result in compensation being recovered by “talking grass” up to the original sale price.

If you return the product because you feel that it is defective, we will examine the returned item and notify you by email within a reasonable period of time of our intention to either (at our discretion) replace the defective product, or provide you with a refund. In the case of a refund, we will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via email that you were entitled to a refund. We will refund the price of a defective product in full and any applicable delivery charges and any reasonable costs you incur in returning the item to us.

We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

We regret that if items are returned using ‘special delivery’ or ‘signed for’ services, we may not be able to refund the whole cost.

Liability

The total liability of “talking grass” for any claim, howsoever arising, shall not exceed the price of the goods supplied by us to the customer.

If you have a valid claim based on the poor condition or quality of your goods and you return them within a reasonable time, you are entitled to choose between a refund or replacement where possible.

These Terms and Conditions do not affect your statutory rights as a consumer.

We endeavour to keep the website up-to-date, but retain the right to update product information without notice.

Offers and promotions

Occasionally we run offers, promotions and sales online which adhere to the following guidelines:

  • All offers are subject to availability. Sale items are limited stock and although a product may show as in stock we may occasionally be unable to fulfil the order, due to increased demand. If we are unable to fulfil an order, you will be sent a letter or email notifying you of this and given a refund for the item
  • Offers cannot be used in conjunction with any other email, Internet or product offer. Only one offer can be applied per order
  • Offers are not transferable or for publication online or offline
  • All offers exclude delivery charges – this applies to both the spend threshold and the application of the overall discount
  • Offer end dates apply
  • Offers are at the sole discretion of “talking grass”, and are subject to variation or withdrawal without notice
  • Offers or promotions cannot be applied to previously placed orders

Free gift promotions

All free gift promotions adhere to the following restrictions:

  • Free gifts will be automatically added to the basket when the offer code is entered at checkout, if the offer requirements have been met. In the unlikely event that the gift becomes unavailable we will substitute with a product of equal or greater value. The exception to this is when the total number of products allocated for the offer has been met – in this instance the total number allocated will be made clear in the offer, eg the first 100 orders placed will receive a free xxx
  • Only one free gift allowed per order and only one order per customer per promotion
  • All free gifts are subject to availability. This refers to the amount of stock available for that particular promotion
  • Any minimum spend amount should be reached excluding the price of the free gift and any P&P

Excluded products from promotions

  • Where an offer includes a monetary discount (eg xx% off or spend £x get £x off) the following items will be excluded from that offer: sale items, gift vouchers, or multi-buy offers.

We reserve the right to amend the offer exclusion list at our discretion and without prior warning.

Use of the “talking grass” site

The use of our site and its content is intended for personal and non-commercial use, by the users of the site. If you use the website in any way that we have not authorised, then we might claim damages or report you for criminal offences. Your use of this website and any dispute about it is subject to the laws of England and Wales.

You may not download, upload, copy, print, display, perform, reproduce, publish, licence, post, transmit or distribute any information from in whole or in part, without the express authorisation of “talking grass”.

Whilst every effort is made to update the information contained on the website, we, nor any third party/data or content provider, can make any representations or warranties, whether express, implied in law, or residual, as to the sequence, accuracy, completeness or reliability of information, opinions, research information, data and/or content contained on the website, and shall not be bound in any manner by any information contained on the website.

We reserve the right at any time to change or discontinue, without notice, any aspect or feature of this website. No information should be construed as advice and information is offered for information purposes only and is not intended for trading purposes. “talking grass” is not responsible for any material submitted to the public areas by you (which include bulletin boards, hosted pages, chat rooms or any other public area found on the website). Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by “talking grass”.

“talking grass” reserves the right to remove any material submitted or posted by you in the public areas, without notice to you, if it becomes aware and determines, in its sole and absolute discretion, that you are or there is the likelihood that you may, including but not limited to:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the rights of other users or third parties
  • Publish, post, distribute or disseminate any defamatory, obscene, indecent or unlawful material or information
  • Post or upload files that contain viruses, corrupted files or any other similar software or programmes that may damage the operation of the website owner’s and/or third party’s computer system and/or network

Customer reviews

All reviews will be reviewed by “talking grass” prior to publishing to ensure they are appropriate and not likely to cause offence. In most instances reviews will then appear alongside the product within a working week. We reserve the right to contact you via email following a review for the following reasons:

  1. Following on from a review where we feel we have relevant, useful information that could help you in the future regarding our products or services;
  2. If you have been selected as the winner of a customer reviews prize draw, should there have been one.


External Sites

Our website and emails may contain links to other websites of interest. However, once you have used these links to leave our website, we do not have control over that website. Therefore we cannot be responsible for the protection and privacy of your information whilst visiting such sites. Please exercise caution and read through their privacy statement in order to understand whether and how they will process data about your visit to their site.

We also use Facebook, Instagram, Pinterest, Twitter and WordPress. We cannot prevent these sites from collecting information on your usage of this embedded content. If you are not logged in to these services, they may still gather anonymous information regarding your usage.
